StarJam Charitable Trust (StarJam) invites teams participating in Money4Jam and their supporters to Use this Money4Jam Website (Website). However, StarJam needs Your help to keep the Website safe.

Permission to Use the Website is conditional on You agreeing to these Terms of Use. By using the Website You agree to be bound by these Terms of Use.

Your Obligations

  1. You must not Use the Website in a manner that breaches any laws or regulations, infringes third party rights or is contrary to any relevant standards or codes, including, but not limited to, engaging in unlawful multi-level marketing, such as a pyramid scheme, via the Website.
  2. You must not post on the Website any content that is offensive, hateful, threatening, pornographic, or that contains nudity or graphic or gratuitous violence.
  3. You must not Use the Website in a manner that interferes with the Use of the Website by others or defames, intimidates, abuses or harasses any person.
  4. You must not solicit login information or access an account belonging to someone else.

  1. The Use of the Website is at Your own risk. StarJam will use all reasonable endeavours to ensure that the Website operates reliably and consistently but does not warrant that the Use of the Website will be uninterrupted or error-free or that the Website or the server that makes it available is free of any virus or other harmful elements.

Intellectual Property

  1. The Website contains intellectual property and other proprietary information. StarJam and other third parties have intellectual property in everything You hear, read, download or access on or via the Website. You are not permitted to do anything in breach of these intellectual property rights, including, but not limited to, copying, modifying or re-posting content, unless StarJam consents to You doing so.

Title

  1. You promise that all the copyright and other intellectual property rights in materials You upload to the Website (including, without limitation, all intellectual property rights in any images, music or other components of any image or footage submitted) is owned by You.
  2. By uploading or sending any material to the Website, You hereby grant StarJam the rights to its content for Money4Jam purposes and furthering StarJam's work. You grant StarJam a non-exclusive, transferable, sub licensable, royalty-free, worldwide license to use any intellectual property content that You submit to the Website. You promise that giving these rights to Starjam and allowing StarJam to use this material will not breach the intellectual property rights or the privacy of any other person.

Exclusion of warranties and liability

  1. To the extent permitted by law, and without limiting Your rights under the Consumer Guarantees Act 1993, StarJam excludes all:
    1. warranties, conditions and representations whether express, implied, statutory or otherwise, relating in any way to the Website, Your Use of the Website and the information, products and services supplied, offered to be supplied or advertised or accessed through the Website, and
    2. liability (including for negligence) to You or anyone else in respect of any loss or damage (including special, indirect or consequential loss or damage), costs and expenses suffered by You or claims made against You arising from or in connection with any Use of the information, products or services supplied, offered to be supplied or advertised or accessed through this website for any reason whatsoever (including negligence).

  1. StarJam does not monitor or investigate websites linked to the Website and accepts no responsibility or liability in relation to any contents of any linked site or any link contained in a linked site, or any changes or updates to such sites. StarJam is not responsible for webcasting or any other form of transmission received from any linked site. By including a link to another site on the Website StarJam is not endorsing it and You use the link at Your own risk.

Indemnity

  1. You agree to indemnify StarJam and its partners, agents, officers, employees and other authorised representatives against all claims, suits, demands, damages, liabilities, costs or expenses arising in any way out of or in any way connected to Your Use of the Website.

Termination

  1. If, in StarJam's reasonable opinion, You fail to comply with any of these Terms of Use StarJam may terminate or limit Your access to the Website.

Updating Terms of Use

  1. StarJam can change these Terms of Use at anytime by updating this posting. The updated terms will take effect when they are posted on the Website. By continuing to Use the Website following such an update You agree to abide by any such revised terms. It is Your responsibility to check these Terms of Use regularly.

Governing Law

  1. These Terms of Use are governed by the law of New Zealand. You submit to the exclusive jurisdiction of its courts and courts of appeal from them.

Privacy

  1. The Money4Jam Privacy Policy forms part of these Terms of Use. All personal information is held in accordance with the Money4Jam Privacy Policy. The Money4Jam Privacy Policy can be found on the Website and You will be taken to have accepted it when You accept these Terms of Use.

Severability

  1. Each provision of these Terms of Use is severable. If any provision is or becomes illegal, unenforceable or invalid, it is to be treated as being severed from these Terms of Use and the rest of these Terms of Use will not be affected.

Definitions

Money4Jam means StarJam's Money4Jam Jam4Money campaign.

Money4Jam Privacy Policy means the Money4Jam privacy policy as set out on this Website.

Use means access, download, install, store, load, post, register, execute and/or display.

You means a person Using this Website.
